In South Carolina, special laws are in place to protect consumers from unscrupulous automobile dealers. The Dealers Act, the Unfair Trade Practices Act, the Uniform Commercial Code, and the Consumer Protection Code all regulate various aspects of a vehicle purchase.
Motor Vehicle Dealers Are Prohibited From:
- Engaging in any action which is arbitrary, in bad faith, or unconscionable
- Engaging in unfair or deceptive acts or practices in the sale of motor vehicles
- Requiring car buyers to also purchase special features, appliances, equipment, parts, or accessories not desired or requested by the purchaser
- Representing and selling as "new" any vehicle which has been used and operated for demonstration purposes or which is otherwise a used motor vehicle
- Using any false or misleading advertisement
- Selling a vehicle without transferring valid and marketable title to the vehicle
- Misrepresenting a vehicle's mileage or tampering with the a vehicle's odometer
- Failing to disclose that a vehicle offered for sale has been designated as "wreckage" or "salvage" or "lemon"
- Engaging in "yo-yo" sales where the dealer misleads a buyer into believing the purchase is final but then requires the buyer to return to the dealership and sign a new agreement or return the car because the buyer's financing was not approved
- Repossessing a vehicle without sending a 20-day right to cure notice
